1. Who we are and what these terms cover

ThunderYak is provided by Artur Tkachenko, trading as Climb that App, Schützenstraße 29, 83646 Bad Tölz, Germany (“we”, “us”). These terms apply to the ThunderYak iPhone app and to thunderyak.com.

You get the app from Apple’s App Store, so Apple’s Licensed Application End User License Agreement also applies. These terms add to it. Where the two differ, Apple’s agreement governs your relationship with Apple, and these terms govern your relationship with us.

2. What ThunderYak does

ThunderYak describes how the guitar tone of a recorded song was made (guitar, pickup, amp, effects, tuning and settings) and suggests settings for the gear you tell it you own.

3. Information, not a guarantee

We work to make research and settings accurate, but they are a starting point and can be incomplete or wrong. Public sources sometimes disagree, gear varies between units and years, and a guitar, amp and room never sound exactly like a studio recording. Use the settings at your own judgement and protect your hearing and your equipment, for example by starting at a low volume.

5. Right of withdrawal and refunds

Apple sells the subscription to you. Apple’s terms therefore govern payment, any statutory right of withdrawal for digital content and services, and refunds. You can ask Apple for a refund at reportaproblem.apple.com.

6. Fair use of ThunderYak

We may limit or block access that breaks these rules.

7. Content and trademarks

The app, its design and its research and settings are protected by copyright. You may use them for your own playing and share individual settings with friends.

Song titles, artist names, album art and gear names and trademarks belong to their owners. ThunderYak isn’t affiliated with or endorsed by any artist, label or gear maker.

8. Other services and links

The app links to other sites, such as the sources of a song’s research, Songsterr and YouTube. We don’t control those sites and aren’t responsible for their content.

9. Availability and changes

We aim to keep ThunderYak running, but we can’t promise it will always be available or free of errors. We may improve, change or retire features. Research for a song may be updated, which can change its settings.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz) and for any guarantee we have given.

For slight negligence, we are liable only if we breach an obligation that is essential for the proper use of ThunderYak and on which you can normally rely (a cardinal obligation). In that case our liability is limited to the typical damage we could foresee when you started using ThunderYak.

Otherwise, our liability is excluded. These limits also apply to the people who work for us.

11. Ending use

You can stop using ThunderYak at any time by deleting the app. Deleting the app doesn’t cancel a subscription; cancel it in your iPhone’s Settings. We may end or suspend access if you seriously or repeatedly break these terms.

12. Changes to these terms

We may update these terms, for example when ThunderYak or the law changes. We’ll announce important changes in the app or on this page before they take effect. If you keep using ThunderYak after that, the new terms apply.

13. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory laws of the country where you live.

14. Disputes

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. If something goes wrong, please write to us first at hello@thunderyak.com.
